Commercial conditions
NON-RETURNABILITY Custom-made products are products made to the specifications presented by the customer or clearly personalized. Consequently, to the extent that the contract is concluded remotely or outside commercial premises, the customer declares that he has been informed that for these products he does not benefit from the right of withdrawal provided for by consumer protection legislation. This clause does not affect the consumer's legal rights regarding product conformity and the remedies provided for by law in the event of manufacturing defects or hidden defects. In order to ensure the correct installation of the products, the supplier may offer transport and assembly services carried out by qualified personnel. If the customer refuses the assembly carried out by the supplier and opts for assembly on his own or through third parties, the supplier does not assume liability for any defects resulting from improper assembly. The product warranty does not cover damage caused by assembly carried out by unauthorized persons. RECEIPT OF THE PRODUCT The customer is obliged to check the product at the time of delivery or collection, in terms of integrity, apparent compliance with the order specifications and the existence of any visible defects. By signing the receipt document, the customer confirms that the product has been delivered and that, at the date of receipt, he did not find any visible defects, except for those recorded in writing in the delivery and receipt report. Any objections regarding visible defects or apparent shortages will be recorded at the time of receipt. In the absence of such mentions, the product is considered to have been received without reservations in terms of visible defects. This clause does not remove the customer's right to invoke, under the law, manufacturing defects or hidden defects that could not reasonably be identified at the time of receipt. UNJUSTIFIED REFUSAL OF THE PRODUCT The customer's rejection of products made according to the specifications approved by the order is not allowed in the situation where the product complies with the technical specifications established in the contract. If the customer unjustifiably refuses to take over the product, the supplier has the right to request full payment of the product price, as well as any additional costs generated by transport, handling or storage. IMPLIED ACCEPTANCE OF THE PRODUCT If the customer takes over the product and does not make written objections regarding any apparent non-conformities within 48 hours of delivery, the product is considered accepted in terms of visible defects and apparent conformity with the order. This presumption does not apply to manufacturing defects or hidden defects that could not reasonably be detected at the time of receipt and does not limit the customer's rights provided by law in the matter of the legal guarantee of conformity. WARRANTY The products benefit from a warranty for manufacturing defects in accordance with the legislation in force. The warranty covers exclusively manufacturing defects of the product and does not cover damage resulting from improper use or from interventions carried out by unauthorized persons. The warranty clauses and warranty exclusions do not affect the consumer's legal rights regarding the conformity of the product, to the extent provided by law. . WARRANTY EXCLUSIONS The warranty does not cover damage resulting from improper use, normal wear and tear, stains or soiling of the materials, accidental damage or damage caused by animals. INSTRUCTIONAL NATURE OF SAMPLES The customer declares that he has been informed that the material samples represent only a fragment of the material used for the production of the furniture. For this reason, there may be minor differences between the sample and the final product in terms of: • the shade of the material • the texture of the material • the reflection of light on the surface of the material These differences are normal and do
DECLARATION ON THE CHARACTERISTICS OF UPHOLSTERED FURNITURE
This declaration is an integral part of the Contract / Order Form for custom-made furniture. 1. UPHOLSTERED FURNITURE PARTICULARITIES The Customer declares that he has been informed clearly, completely and prior to placing the order that the products made by the supplier are furniture products manufactured exclusively to order, according to the individual specifications of the Customer. The Customer confirms that custom-made furniture involves manual or semi-manual production operations and the use of natural or textile materials, which is why the products may present aesthetic or functional particularities specific to the production process. These particularities may include, without limitation, minor differences in the shade of the materials, variations in texture, the positioning of the seams, the orientation of the textile fiber or other aesthetic elements inherent in the manufacturing process. The Customer declares that he has been informed of these particularities and expressly accepts that they do not constitute manufacturing defects and cannot represent grounds for complaint, rejection of the product or request for compensation. 2. BEHAVIOR OF MATERIALS OVER TIME The customer declares that he has been informed that the materials used in upholstered furniture may undergo changes over time as a result of normal use. These changes may include: • relaxation of the textile material • shrinkage of the foam • slight change in the firmness of the seat These changes are considered normal wear and do not constitute manufacturing defects. 3. RESPONSIBILITY FOR USE The customer declares that he has been informed that improper use of the product may lead to its damage. The supplier is not liable for damage resulting from: • improper use • exposure to excessive humidity • use by animals • cleaning with inappropriate substances. 4. ACCEPTANCE OF PRODUCT CHARACTERISTICS By signing this document, the customer confirms that he has been informed of the characteristics of the upholstered furniture and that he accepts these particularities. The customer declares that these aspects will not constitute grounds for complaint regarding the conformity of the product.

Terms and Conditions 1. Use of this site. Using this site and placing an order on it implies acceptance of the terms and conditions expressly and exclusively written on the page. SC GOLD SOFA SRL may modify these provisions at any time, without prior notice. The most recent version can be found online only by accessing the "Terms and Conditions" page. According to art. 1270 of the New Civil Code, the validly concluded contract has the force of law between the contracting parties. The company SC GOLD SOFA SRL carries out the activity of presenting services exclusively through the website www.goldsofadesign.com, being the only online property it owns and through which it carries out acts of commerce and presentation of services. Any other associations or the unauthorized presentation of the company's data does not bind SC GOLD SOFA SRL in any way. towards any natural or legal person. 3. Acceptance of the terms of use. The use of the website https://www.goldsofadesign.com, logging in and accessing the services offered represents an acceptance by the consumer of the terms and conditions detailed below, with all the consequences arising from their acceptance. In the event that the consumer agrees to these conditions, we request the refusal to use our website or place any order. SC GOLD SOFA SRL reserves the right to update and/or revise the Terms and Conditions displayed on the website at any time without prior notice. With this argument as a basis, we ask consumers to periodically monitor any changes, at least before placing an order. By registering an order on the website www.goldsofadesign.com, https://www.facebook.com/goldsofa.ro, the buyer agrees to the communication method used by SC GOLD SOFA SRL, namely by phone or email. The conclusion of the contract takes place only when the tax invoice is issued and not when the order is launched or the automatic confirmation of receipt of this order is issued.
